Terms of Service

Last reviewed: not yet reviewed

These terms are incomplete and have not been reviewed by a lawyer. Several sections below are unwritten on purpose, because the clauses that matter most are the ones that must not be improvised. Do not launch a client site in this state.

Who these terms are between

These terms cover your use of this website, operated by Tampa Bay Emergency Plumbing LLC. They do not cover work we agree to carry out for you — that is governed by the written quote or contract you sign, and if the two ever disagree, the signed contract wins.

What this website is for

This site describes the services offered and lets you ask us to contact you. Submitting the form is a request, not a booking, and no work is scheduled until we have spoken and confirmed it with you.

Quotes and pricing shown here

Prices shown on this site are starting points for typical work. The price for your job is the one in the written quote given after we understand the specifics. Nothing on this page is a binding offer.

Limitation of liability

To be drafted: A lawyer must draft this. It has to cap liability, exclude indirect and consequential loss, and carve out what cannot lawfully be excluded (death, personal injury, fraud, and in many US states gross negligence). A cap drafted badly can be struck down and take the surrounding clause with it, which is worse than having none.

No warranty on the website itself

To be drafted: A lawyer must draft this. It disclaims warranties about the site being available, error-free, or accurate. Keep it separate from any workmanship warranty offered on the actual trade work, which is a promise the business genuinely makes and should not be disclaimed here by accident.

Indemnity

To be drafted: A lawyer must decide whether this belongs on a small local-services site at all. It is often disproportionate and can deter customers.

Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed, and using the site after that means the updated terms apply.

Governing law

These terms are governed by the laws of the State of Florida, United States.

To be drafted: A lawyer should confirm the jurisdiction and decide whether a venue clause and any dispute-resolution or arbitration term is appropriate.
